New Form of "Divorce Order"

As from 13 February 2010 the Federal Magistrates Court of Australia will issue divorce orders in a new form. The new form will be called a “Divorce Order” rather than a “Certificate of Divorce” as had been issued before 13 February 2010.

Binding Financial Agreements – Requirements Changed Again

Further changes to the requirements for a financial agreement to be binding became operative on 4 January 2010 designed to address issues raised in previous cases such as Black & Black (2008) FLC 93-357 in which agreements had been set aside because certain technical requirements had not been strictly complied with.

Legislation has been passed by the Senate to allow parties to a defacto relationship who meet the required criteria to bring an application for adjustment of interests in property or an application for spousal maintenance in either the Family Court or the Federal Magistrates Court.
