With an increasingly mobile global population issues often arise that involve the need to take into account the parties rights in different countries. Often these cases are very complex due to the variation in laws and rights of each party in differing countries. This is often referred to as “conflict of laws” as it relates particularly to international family law cases. These different rights and entitlements and the conflict between them can arise in matters related to property and financial issues and in relation to children.

When it comes to children, many countries around the world have signed the international treaty known as “The Hague Convention” which greatly assists in the recovery of children removed from one country to another where both countries are signatories to the convention. Unfortunately many countries are not signatories to that Convention and even more complexity arises in these cases.
The lawyers at Cassandra Pullos Lawyers have dealt with many matters involving international child abduction, cases where children have not been returned from an overseas "holiday" and cases where parents simply return to their country of origin with the children without the consent of the other parent.
We have acted on many occasions to prevent children being taken out of the country so as to avoid the trauma and uncertainty of being left to retireve a child if their departure is not prevented. These applications almost always need to be brought urgently and by lawyers who have a good knowledge of the applicable law, the procedure in the Courts and in liaising with the Australian Federal Police and the various government departments that can be of assistance.

The division of property can raise issues about international family law and the interaction between different laws in different countries. Some parties may find they have a choice of country to bring their proceedings in, others won't have that choice but may need to trace, value or protect assets in other countries. Many cases involve all of those issues.
