New Application for Consent Orders

The Family Law Application for Consent Orders Kit and Form has been amended. The current forms can be used until 1 February 2011, after that, the new forms must be used. You can contact us for more information about Consent Orders.
The main changes to the new forms are as follows:

There is no longer a requirement for a certificate of marriage or birth certificate to be provided

There is no longer the requirement to swear or affirm an affidavit in support of the application; all parties are required to sign is a “Statement of Truth”.

Geographic requirements for de facto property orders have been extended to include South Australia.

There is a new question which requires further information and details from parties as to why the children spending equal or substantial and significant time with each parent is practicable or why it is not in the child’s best interests to spend time with each parent.
